Contractual documents
The purpose of these general terms and conditions, which form an integral part of the contract, is to define the terms and conditions under which the company ARDREY SRL, whose registered office is located at rue Léon Champagne 5, 1480 TUBIZE, operating the MONDO HOTEL Hotel – Restaurant – Coworking establishment (hereinafter referred to as “the MONDO HOTEL”), enables its customers to benefit from all services, in particular reservations.
By customer, MONDO HOTEL means any natural or legal person who intends to use the services offered by MONDO HOTEL, either directly or indirectly.
The customer is invited to read these terms and conditions carefully, whose prior and unreserved acceptance is mandatory in order to book and benefit from the services offered. By booking and/or paying, the customer acknowledges having read and understood these terms and conditions.
Any deviation from these terms and conditions must be made in writing and signed by all parties. The MONDO HOTEL reserves the right to modify or supplement, at any time, all or part of these terms and conditions, it being understood that the customer will only be bound by the version in force at the time of booking the service.
Object
Customers can book hotel rooms, coworking spaces and light catering services by email direction@mondohotel.be or via the website.
The essential characteristics, dates of availability, price, options offered, payment conditions and special sales conditions applicable to the fare selected (guarantee policies, cancellation conditions, check-in time, member fare conditions, etc.) are explicitly indicated in each offer and during the booking process described below.
Additional services can be booked, such as breakfast. Complementary services also refer to travel services within the meaning of Article 3.1 of Directive (EU) 2015/2302 of November 25, 2015 on package travel and linked travel services, likely to form with accommodation services either a “linked travel service” or a “tourist package” according to the criteria specified by the Directive. This information is communicated to the customer prior to booking these services in the special conditions specific to each offer.
The MONDO HOTEL enters into partnership and distribution agreements with third-party websites. The conditions of sale applicable to these partner services are available on the partner’s website.
Reservation
Services can be booked by telephone, in writing or by e-mail direction@mondohotel.be. In the latter case, the booking process varies according to the customer’s navigation and request, and comprises the following stages:
1. Information on search criteria and, if applicable, one or more complementary services;
- Results and selection of one or more additional services;
- Details and characteristics of the service(s) selected, in particular in the case of accommodation: characteristics of the accommodation (room size, TV, etc.), length of stay, options offered (e.g. breakfast, wifi access, etc.), total price of the booking including details of applicable taxes, legal information form in the case of a linked travel service or tourist package, and any special conditions that may apply (guarantee policies, terms and conditions, etc.).), the total price of the reservation including details of applicable taxes, the legal information form in the case of a linked travel service or tourist package, and any special conditions that may apply (guarantee policies, cancellation conditions, check-in time, etc.);
- Summary of service(s) booked with : (i) a reminder of the main features (duration, characteristics of the service and/or additional service(s), amount including VAT with details of applicable taxes) and (ii) the customer’s personal details: either by logging in to an existing account, or by filling in all the mandatory fields (indicated by an asterisk);
- Finalization of the reservation of the service(s) by the customer with : (i) the information of its means of payment, in the event of request for guarantee of reservation of the services and: (ii) consultation and acceptance of the general terms and conditions of sale, the Privacy Policy, the terms and conditions of use of the website and any special conditions relating to the reservation before it is validated by the customer;
- The MONDO HOTEL takes into account the reservation of the service(s);
- An e-mail confirming the booking of the service(s) is sent to the customer, summarizing the service(s) booked, the price(s), the special conditions accepted by the customer, and the date of the booking.
A reservation is deemed to have been made as soon as the customer clicks on the “Finalize your reservation” page. (i) in the case of a prepaid booking, on the “Pay” button, or (ii) in the case of a reservation to be paid for within the MONDO HOTEL, on the “Confirm” button. The customer may book services in the name of one or more other person(s), up to a maximum of 10 (ten) rooms.
Bookings made by the customer via partner services are made via the website and mobile services of each partner. Reservations are made directly between the customer and the partners, following the steps on the partners’ website and mobile services.
Price
When confirming the booking of a service, the total price is indicated to the customer in euros, including VAT, and is only valid for the duration indicated. Only the price indicated on the website is binding for the MONDO HOTEL.
Unless otherwise stated, options not offered at the time of booking are not included in the price.
For accommodation, prices are per room for the number of person(s) and date selected.
Prices include VAT applicable on the date of booking, and any change in the VAT rate will be automatically reflected in the price indicated on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the price indicated on the date of invoicing.
Payment
General provisions
Payment must be made directly to the MONDO HOTEL on arrival, except for “non-refundable” rates, for which payment is made immediately on booking. Payment for additional services billed after your stay must be made when you check out.
The MONDO HOTEL reserves the right to request a deposit before the customer takes possession of the room, or to request pre-authorization, in order to guarantee payment of any additional sums due at the end of the stay.
All sums due or to be due are subject to interest on arrears at the rate of 12% per annum, on the due date and without formal notice. An additional indemnity corresponding to 10% will be due for collection costs, without prejudice to the right to claim additional damages covering the actual loss.
The customer communicates his payment data either (i) to prepay the reservation before your stay (ii) as a reservation guarantee (iii) the online check-out procedure offered as part of the online check-in service. In the event of payment on site, the MONDO HOTEL may accept other means of payment, but the customer must present the credit card used to guarantee the reservation or make the prepayment. MONDO HOTEL may also ask for proof of identity to prevent credit card fraud. An invoice will be sent in electronic format to the e-mail address provided by the customer at the time of booking.
Prepayment
Prepayment refers to any payment made by the customer at the time of booking. At the time of prepayment, the amount debited at the time of booking includes the total amount indicated at the time of booking (including all applicable taxes, with the exception of any tourist taxes) and, where applicable, the price of the options selected.
Bank guarantee
The guarantee of a reservation by credit card means that the customer’s payment details are taken at the time of booking. The customer’s credit card is not debited and payment is made directly on site on the day of arrival or departure, unless the customer fails to show up and has not previously cancelled the reservation in accordance with the cancellation conditions of the rate booked.
Cancellation – no-show
The following cancellation conditions apply to room reservations, depending on the rate plan applicable to each reservation:
In the absence of cancellation within the time limits set out in the table above, the first night’s stay, including all related complementary services, will be payable.
Arrival/departure
Arrival at the MONDO HOTEL is no later than 10:00 pm.
Unless otherwise stipulated in the contract, customers must vacate their rooms by 10 a.m. at the latest.
In the event of late check-out, after 10.00 am, a fee of €50.00 (fifty euros) will be charged.
If the room is not vacated by 2:00 p.m. at the latest, an additional night will be charged at the daily rate.
Personal data
The MONDO HOTEL undertakes not to divulge confidential information (financial information, invoicing data, etc.) to third parties other than as necessary (e.g. a subcontractor).
As the building is protected by video surveillance, the customer’s image is collected and stored for a maximum of 30 days. All data collected by the MONDO HOTEL complies with current legislation, including the R.G.P.D.. He was discharged
to the established Privacy Charter. By accepting these terms and conditions, the customer consents to the transfer of his/her personal data to MONDO HOTEL, in accordance with the Privacy Policy.
Customer obligations
The customer is solely responsible for the choice of services and their suitability for his or her needs. The customer is also solely responsible for the information provided when creating an account and/or booking a service. MONDO HOTEL cannot be held responsible for any erroneous or fraudulent information provided by the customer. Furthermore, the customer alone is responsible for the use of his/her account and for any reservations made, whether in his/her own name or on behalf of third parties.
The customer acknowledges that he/she is in a place open to the public and therefore undertakes to behave appropriately, in particular by refraining from any behavior or use contrary to the law, public order or public decency.
In general, the customer is required to use the spaces, infrastructures and equipment with due care, and any behaviour to the contrary will result in the customer being asked to leave the premises without any compensation and/or without any reimbursement if payment has already been made. If no payment has yet been made, the customer must pay the price of the services consumed before leaving the premises. A fixed indemnity of €200.00 will be payable, without prejudice to the MONDO HOTEL’s right to claim additional indemnity to compensate for the damage actually suffered.
Pets are not allowed.
The customer acknowledges that all areas of the MONDO HOTEL are strictly non-smoking (including electronic cigarettes). A fixed indemnity of €200.00 will be payable in the event of violation of this prohibition without prejudice to the MONDO HOTEL’s right to claim additional indemnity intended to compensate for the damage actually suffered.
The customer must not bring into the MONDO HOTEL food or drink from outside sources.

Minors may only stay at the MONDO HOTEL if accompanied by an adult and in possession of personal identification. If the accompanying adult is an adult other than the parents, he or she must have parental authorization from the child’s parents.
The customer also undertakes to ensure that the computer resources made available by the MONDO HOTEL (in particular the WiFi network) are not used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the intellectual property rights when such authorization is required. The customer is also required to comply with the Internet service provider’s security policy, including the rules governing the use of security measures implemented to prevent the unlawful use of IT resources, and to refrain from any action that may undermine the effectiveness of these measures.
The customer is responsible for and indemnifies the MONDO HOTEL against all damages of any kind whatsoever caused by him/her and/or his/her guests within the MONDO HOTEL and shall bear all costs incurred as a result of such damages and/or non-compliance with the aforementioned rules. MONDO HOTEL reserves the right to intervene if necessary and to take any appropriate action against the customer.
MONDO HOTEL liability
The MONDO HOTEL undertakes, as part of an obligation of means, to provide access to the services offered in compliance with the general terms and conditions and to act with diligence and competence and make every effort, within reasonable limits, to remedy any malfunction brought to its attention as soon as possible.
The MONDO HOTEL cannot be held responsible in the event of theft, loss or omission of equipment and personal effects belonging to the customer, nor in the event of accidental interruption of a distribution or service, nor in general in the event of an incident or accident due to a cause beyond the control of the MONDO HOTEL, its representatives or agents.
Force majeure and dislodgement
Neither party shall be liable to the other in the event of non-performance of its obligations resulting from force majeure. It is expressly agreed that force majeure suspends the parties’ performance of their mutual obligations, and that each party shall bear the costs arising therefrom. Cases of force majeure are those usually recognized by the case law of the Cour de cassation (French Supreme Court). If the event of force majeure lasts for more than (30) days from the date of its occurrence, the hotel contract may be terminated by either party without either party being entitled to claim damages.
Claims
Complaints relating to the services provided will only be taken into consideration if they are received in writing by the sales department within seven calendar days from the day following the performance of the service. Once this period has elapsed, the services are irrevocably deemed to have been correctly performed.
Personal data

By accepting these terms and conditions, you consent to the transfer of your personal data to MONDO HOTEL, in accordance with the Privacy Policy.
Miscellaneous
The invalidity or non-application of any clause of these terms and conditions shall not affect the validity or application of the other clauses. The parties then undertake to replace the said clause with a valid clause that is economically close.
MONDO HOTEL’s failure to enforce these terms and conditions shall not be deemed an implied waiver by MONDO HOTEL.
Jurisdiction and applicable law clause
The service contract and the general and special conditions which form an integral part of it are governed by Belgian law.
the courts of the judicial district of Nivelles have exclusive jurisdiction.
In the case of accommodation services, after having referred the matter to the customer service department in an attempt to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the customer, in the case of private travel, may refer the matter to the consumer mediation service via the following link https://ec.europa.eu/consumers/odr/.
The customer is also informed of the existence of a European platform for Online Dispute Resolution (“ODR”) to which he/she may have recourse. Customers can access it via the following link: https://ec.europa.eu/consumers/odr/.
Special conditions applicable to coworking and supplementing the general conditions
Purpose of the contract
On the ground floor of its premises, the MONDO HOTEL has set up a meeting room, seminar room and business center.
providing access to a set of inseparable services based on a complete, integrated infrastructure – the MONDO HOTEL. Meeting, seminar and business room services are VAT-taxable services.
All services are provided to the coworker for a single flat fee. No reduction in price can be granted if the coworker does not make use of all the services offered.
The coworker declares that he has visited the premises, acknowledges that they are in an excellent state of repair and are clean.

Coworking services include:
Provision of common areas and sanitary facilities; – Provision of an Internet connection;
Price – Invoicing – Payment
The price includes the provision of the space and services as described in the formula chosen by the coworker, as well as taxes and charges relating to the building and its equipment.
Invoices are sent electronically to the contact address given at registration. Access to coworking spaces and associated services is subject to payment of a pass.
Payment is made by bank transfer or standing order for subscriptions. The price is payable according to the terms set out in the special conditions.
All sums due or to become due are subject to interest on arrears at the rate of 12% per annum, on the due date and without formal notice. An indemnity of €40 will also be due for collection costs.
Cancellation – no-show
The following cancellation conditions apply when booking coworking services, depending on the price plan applicable to each booking:
Insurance – Security – Alarm
The MONDO HOTEL declares that the building is covered by fire insurance. The coworker acknowledges that this insurance does not cover its contents.
The coworker is liable to the MONDO HOTEL and to any third party for any damage or loss caused by fire.

The amount due for any intervention by the security group (or the police) following the triggering of an alarm.
